How to Mark DORMANT for ESI filing of a newly started company ?

Attention is hereby drawn to all Factories/Establishments registered through MCA portal and obtained ESI Code Number.
Kindly start compliance under the provisions of ESI Act from the date of reaching the threshold limit of employees i.e 10 coverable employees.

If your unit is not having 10 coverable employees i.e not coverable under the provisions of ESI Act, you need not make compliance for next 6 months from the date of registration OR till you reach the threshold limit of employees i.e 10, whichever is earlier. There is a status provision called ‘DORMANT’ mode in your ESI login which should be activated if your unit does not reach the threshold limit in 6 months. In case if you do not extend the same, the registration will get activated automatically and you need to start complying under ESI Act failing which, necessary action under the provisions of ESI Act will be taken. The maximum period for which dormant status can be extended is 6 months or 180 days only.

Hence you are advised to start compliance from the date of reaching the threshold limit of employees and follow the above guidelines diligently without any deviations. For queries, please feel free to contact our Office on aforementioned Address/Email/Phone.

In CORRIGENDUM Issued by ESI “ It is to inform all MCA registered units that in the Notice dated 08/12/2022, wherever “10 coverable employees” appears, it may be read as “10 employees”.
